BREAKING: Court gives INEC 5 days ultimatum to fix date for C'River North Senate Bye-Election.


A federal High court sitting in Abuja has ordered the Independent National Electoral Commission(INEC) to fix a date and organize a Bye-Election to fill the Cross River North Senate seat following the demise of late Sen. Rose Okoji Oko.
 
The case which was filled by Hon Koko Dan, Idagu Thomas Odey and Hon Stephen Ogar obtained a Judgement Order in Abuja on 17 July, 2020.

The judgement as contained in Suit No FHC/ABJ/CS/694/2020 Declared Judgement Compelling INEC To Conduct By-Election In CR-North reads;

1) A declaration that by virtue of Section 76(2) of the 1999 Constitution & Section 25(2) of the Electoral Act (as amended) the Independent National Electoral Commission, INEC to conduct a by-election and fill a vacancy in the Cross River North Senatorial District not later than one month after the occurrence of the vacancy.

2) An order of Mandamus compelling INEC to organize and fix a date for the by-election to fill the vacancy in CR-North Senatorial District within 5 days from the grant of this order.

The notice was filed at the Federal High Court , Abuja on the 1st day of July, 2020 and judgement delivered on the 17th of July, 2020.
